Reuters reports that Apple has filed a lawsuit in San Diego against Motorola over usage of a Qualcomm patent. The Cupertino-based tech giant argues that the lawsuits currently in action in Mannheim, Germany are in breach of the license between Motorola Mobility and Qualcomm as the patent to which the arguments pertain have also been licensed to Apple.
Motorola’s German lawsuit is in direct breach of a Patent Licensing Agreement between Motorola and Qualcomm. As a Qualcomm customer, Apple is a third-party beneficiary of that contract.
The patent in question is related to the usage of the Qualcomm MDM6610 baseband chip that Apple uses in the CDMA-compatible versions of its iPhone 4S.
